BPE's trained mediators provide a safe, confidential and supportive environment allowing you to discuss and resolve your issues.
Mediation is a voluntary and confidential way of resolving disputes without the need for court action. It involves an independent third party, called a mediator, working with two or more individuals/groups to help them reach a solution that is acceptable to everyone. The mediator is completely impartial, they cannot provide legal advice but they can give a wealth of information about the law and the Court's approach in similar cases.
BPE has a number of trained mediators who specialise in a variety of different areas, including Construction, Family, Intellectual Property and Litigation.
There are various benefits to choosing to go through the mediation process, rather than court. These include:
- Cost. While a mediator may charge a fee, the mediation process usually takes less time than going through the court. In turn, this often means less money is spent on fees.
- Confidentiality. Mediation sessions remain strictly confidential. Usually, what is said or written during mediation cannot be used in court proceedings, although there are some limited exceptions to this rule.
- Control. The disputing parties retain complete control of decisions at all times, including whether or not to settle and on what terms. In a court situation the control resides with the judge or jury.
- Compliance. Because the agreement has been mutually reached, compliance with the outcome is usually high. This can often mean further costs are avoided in the future because disputing parties will not have to return to court or pay a lawyer to force compliance.
If mediation is not possible face to face, we are able to offer digital mediation via Zoom, Skype, WhatsApp or FaceTime. This can be carried out in the same way as a face to face session and the mediator will ensure confidentiality at all times.

Family Mediator - Helen Cankett

Helen is an experienced Family Mediator and specialises in all aspects of divorce and separation, including financial matters and arrangements for children. She holds the Family Mediation Council’s Full Competency in All Issues Mediation.
2007-2011 Whilst a Solicitor at Rickerbys LLP, worked with Cheltenham Family Mediation as Co-Mediator on a variety of cases, including All Issues, Finance & Property and Child Only.

Intellectual Property Mediator - Riyaz Jariwalla

Riyaz specialises in intellectual property litigation with experience in a full range of contentious IP matters, including advising and representing clients in relation to registered trade mark infringement, registered and unregistered design infringement, patents, copyright infringement, confidentially, passing off, seizure of counterfeit goods and domain name recovery.
His experience extends to proceedings in the High Court and the Patents County Court and trade mark and design oppositions and challenges, both at the UK and EU levels, before the UK Intellectual Property Office (“UK IPO”) and the Office of Harmonization in the Internal Market ("OHIM").
Riyaz also has over five years of experience dealing with non-contentious intellectual property matters, such as strategic IP management, brand protection, freedom to operate and clearance searches, product launches, IP audits, filing trade mark applications, objections and oppositions and filing design applications before the UK IPO and OHIM.
He also have a wealth of experience managing the renewal of registered rights and their exploitation by way of drafting commercial agreements such as assignments of rights, licences and other commercial agreements.

Litigation Mediator - Philip Radford

Philip has over thirty years experience advising businesses and business owners in relation to disputes. He advises clients in relation to a range of disputes including commercial contracts, intellectual property, banking claims and disputes between directors and/or shareholders.
Philip is a member of the Professional Negligence Lawyers Association (PNLA) and has particular expertise in advising clients who have incurred a loss as a result of advice from a professional advisor.
He is also an avid classic car enthusiast and has advised classic car owners who have had issues with the car they have purchased.
