Divorce affects personal and financial aspects of life and can leave you with a lot to consider. Early guidance when a marriage has broken down can clarify the divorce process, helping you make informed decisions.

Our team of family lawyers specialise in alternative dispute resolutions, including mediation and collaborative law, to keep the process amicable when possible. Helen Cankett, our Accredited Mediator, assists couples in reaching agreement without court intervention.

Separating assets when your relationship ends

Agreeing financial arrangements between divorcing couples can be complex. Generally, these cover:

  • asset separation
  • property division or agreeing who will remain in the family home
  • pension arrangements
  • division of investments
  • future financial child maintenance and spousal support

If mutual agreement is reached, we can apply for a legally binding consent order. Alternatively, our Family team includes an Accredited Mediator who can support you to achieve an agreement that you are both happy with, without having to resort to court action. When an agreement cannot be reached via mediation about the division of finances, you can apply to the court for a financial order.

Pensions

Pensions are valuable assets often divided during divorce. When one party relies on the other financially or contributed significantly to a pension, we advise on fair pension distribution as part of your settlement.

Freezing assets

If one party is found to be dissipating assets, a court-ordered freezing order can protect the other party’s financial interests. Our team can assess if this is necessary and advise on the next steps.

Separation agreements

Separation agreements formalise financial arrangements before divorce proceedings, outlining how assets will be divided and are essential when separation is used as a divorce ground.

Maintenance

We offer guidance on child maintenance and spousal support, ensuring ongoing financial provision to meet children’s and spouses’ needs where applicable.
