Public procurement is a highly regulated area of law and can be very complex to adhere to. For the purposes of Public Contract Regulations 2015, public procurement is the purchase of goods, services, or works by a public body (such as the government) by public contracts.
While procurement can be done by any business, public bodies and certain utility sector bodies are more heavily regulated to increase the likelihood of contracts being awarded to the most suitable partner.
Procurement
Prior to Brexit the public procurement process was governed by an EU structure. This has changed and new rules for the procurement process have been set out in the Withdrawal Agreement.
Our team can act for both public bodies wishing to comply with the rules and properly advertise their contracts, as well as private sector organisations looking to tender. We can advise on the whole procurement process:
Pre-market engagement
Initial scoping
Potential exemptions
Drafting and preparing all documentation (procurement and contractual)
Negotiations with bidders
Award process
We are experts in dealing with non-contentious procurement matters and work with clients across the public sector to apply for and win procurements, and we work with our Commercial Litigation Team to advise clients should they receive a challenge to the procurement or a dispute arises after a procurement is won.
